NuVasive Rods for Scoliosis May Fail – File Your Legal Claim Here

Scoliosis is an abnormal curvature of the spine which is said to affect close to 8 million Americans. Scoliosis has an onset of between 10 to 15 years of age, but some children may show signs much earlier especially if there is a hereditary aspect or someone else in their family has the condition. Scoliosis must be treated as a matter of urgency because there is the risk of the spine to permanently curve and stay that way for the rest of the individual’s life.

The NuVasive spine technology surgery usually involves the surgical implantation of two rods above and below the spinal curvature, and every six months, these rods are manually adjusted in order to correct the spinal growth. Over time, it is hoped that the curvature can be corrected, and that the child can go on to live a normal life, with a straightened and normal spine.

Traditionally, early onset scoliosis was treated via:

  1. Surgery
  2. Back braces
  3. Body casting
  4. Watchful waiting, done to see if the condition will correct itself

Some of the most common complications of the NuVasive Magec system include:

  1. Metallosis, which refers to metal debris breaching various parts of the body due to the roads leaking metal on account of actuator cap separation. The body treats pieces of metal as foreign matter, thereby launching an inflammatory response, and in some cases, leading to the development of autoimmune conditions
  2. Distraction failure which refers to the rods not staying at the location they are supposed to, thereby leading to the development of chronic pain and even causing further spinal deviation over time.
  3. Catastrophic failure on account of the breaking of the NuVasive Magec rods which can cause debris from the rod to travel to different parts of the body, causing spinal and nerve damage, and in some cases, paralysis if not caught in a timely manner.

A pin in the rods has been found to detach on a regular basis, and this could be surmised to mean that the NuVasive rods were defectively designed or manufactured. In addition, corrosion of the rods has been shown when a study was run back in 2017 in order to assess the efficacy and utility of the NuVasive Magec system.
