Underlying + Underinsured Motorist Coverage Policy Limits without Lawsuit

We could all do with a simple reminder from time to time about the dangers of running or even slowly rolling through a stop sign or traffic light without coming to a stop ad waiting your turn. Attorney Michel Sheldon recently secured a policy limits settlement for our client, Taylor, in an underinsured motorist (UIM) claim. Taylor was approaching an intersection when another driver unexpectedly drove through a stop sign.
Taylor had no time to avoid striking the passenger-side of the other vehicle. It was a forceful impact that caused Taylor’s airbags to deploy.
Fortunately, there were witnesses nearby who told the police officer that the other driver pulled out in front of Taylor.
Taylor was holding the steering wheel with both hands at the time of the collision. She fractured her right wrist in the impact and had to wear a wrist cast followed by a split.
Fortunately, she did not require surgery.
Michael settled her bodily injury claim against the at-fault driver for the full policy limits. After going back and forth with Taylor’s insurance company, and threatening to file a lawsuit, Michael secured the maximum compensation for Taylor from her own insurance policy’s underinsured motorist coverage (UIM) while avoiding litigation.
We’re always excited to recover the full insurance benefits for our clients without having to file a lawsuit. This saves the client the time, expense and stress of litigation.
