Car crash yields two settlements – workers’ comp and liability

Many people drive for a living.  Whether a UPS driver or delivery driver or truck driver, many people drive for a living.  When someone is an auto accident, and they were on the clock for their employer, they have two cases.  This situation occurred with one of our clients recently.  Our client drive shuttle company at the airport.  Another car blew the ran red light and broad sided our client while driving the shuttle van.  Because he was driving on the job, he had a worker’s compensation case.  Our office was able to get all his medical bills paid, 2/3 of his salary while he was off from work, and a settlement for his personal injury case.  However, because the accident was the fault of the other driver, we were able to make a claim against the insurance company for the other driver.  Our client went to the emergency room, his primary care physician, and then followed up with a course of physical therapy.  Because of his symptoms, his doctor referred him for an MRI.  An MRI is a test which can show damage to the discs between the vertebrae.  Fortunately for our client, the MRI was negative.  His pain gradually resolved and he returned to his pre-accident condition.  However, our firm was able to get two excellent settlements for our client, one from the workers’ compensation insurance company and another against the insurance company for the at fault driver.  It is important to have a knowledgeable lawyer who can make recoveries against all potential defendants.
