It is important to know that recurrence, according to the OWCP, is not the same as ‘reoccurrence’. According to them, recurrence of a medical condition is the documented need for additional medical treatment after being released from medical treatment. If you need to receive further treatment for your current injury, you are not considered to be experience a recurrence.
Your recurrence of disability should caused by one of the following:
- A spontaneous return of the same signs and symptoms you experienced when you sustained your first injury.
- You must experience an increase or return of disability as a result of a consequential injury which is an injury caused by the impairment or weakness from your original injury
- You must have withdrawn from a specific light duty assignment where you were unable to perform all duties of your regular full position. It is important to note that your withdrawal should have not have been caused by misconduct or non-performance of your work duties.
For this kind of injury, you’ll fill in a form CA-2A. You will also need to work closely with a doctor who can document the recurrence and definitively show using evidence that you suffered further injury. OWCP takes these claims seriously, and it is not uncommon for them to issue compensation much faster for recurrence of an injury compared to a new/fresh claim.
