Bard PowerPort Class Action Lawsuit Update in October 2024 – It is Not Too Late to Join the MDL

Implantable venous access devices are an indispensable part of disease management these days owing to the fact that more patients are developing an aversion toward injectable medication by way of a syringe and the fact that some conditions may need ongoing medicine administration or the drawing of blood, which may be carried out once a day or several times a week, making injections not only painful but time-consuming and tedious. The Bard PowerPort is a type of implantable venous access device whose purpose is to allow the efficient administration of fluids, medications, and blood products. It is ideal, especially for patients who are undergoing chemotherapy as well as those who need long-term intravenous therapy, such as those in medically induced comas or those whose digestive systems cannot assimilate medication for one reason or another.

The Bard PowerPort device is placed under the skin and connected to a catheter, which goes into a major vein, and medication and other fluids are injected into a reservoir in the device, which contains a self-sealing valve that closes up after the medication or fluids are delivered. Despite the device’s efficacy, there have been thousands of individuals who have come forward alleging that they suffered health complications after being fitted with this device, with most patients alleging that the catheter either fractured and migrated into the body, causing embolisms, they developed infections due to contamination of the valve, or developed blood clots or disease progression on account of the device’s inefficacy. To this end, multiple lawsuits have been filed, and these have been consolidated in a special type of class action lawsuit known as an MDL, which you can join if you were affected if you act fast and reach out to us with your claims today.

Bard PowerPort Class Action Lawsuit Update in October 2024

As of October 2024, there are currently 1,200 lawsuits pending in the Bard PowerPort MDL. The MDL is being overseen by Judge Jennifer G. Zipps, and it has been designated as MDL 30139, in which various allegations such as design defects, insufficient warnings and injuries to patients have been leveled against Bard Medical, a C.R. Bard, Inc. subsidiary.

Status conferences have been ongoing, and the purpose of these conferences is to discuss the discovery process and take a look at some of the motions filed by either party. On October 15th, 2024, one such conference was held where attorneys for plaintiffs decried the difficulty they were going through when it came to obtaining documents from Bard Medical during the discovery process, documents which are needed to establish whether Bard Medical knew about the inherent risks associated with their device, in particular the device’s safety and design defects. During this conference, the groundwork was laid for the inclusion of expert testimony which will be pivotal once the trial is underway when it comes to establishing liability and causation.

In addition, Bard Medical has filed a number of motions to dismiss certain cases, citing insufficient demonstration of causation. The court has taken it upon itself to review these motions and is expected to rule on them in the coming months. Should the judge grant these motions, numerous cases could be struck off the MDL, which may not bode well for the outcome of the MDL in general going forward.

Bard PowerPort Bellwether Trials and What This Means for You

Bellwether trials are also coming up, with the first one slated for March 3rd, 2025. These are crucial when it comes to MDLs as they set a precedent with regard to how future claims will be handled, particularly by the jury. In particular, the March 3rd, 2025 trial will involve a plaintiff who claims they suffered a catheter fracture and subsequent embolism for which they underwent multiple treatments, such as surgeries, in order to remove the fractured bit of the catheter. In addition, more Bellwether trials are slated for June and September 2025 and these will also influence the outcome of other cases in the MDL.

Bellwether trials test the legal air, so to speak, to determine the potential outcomes of future cases. Should juries respond positively to plaintiff claims, Bard may be more inclined to agree to settle cases that may be pending in order to avert a trial that may see them lose and be ordered to pay hundreds of millions of dollars in damages.
